1. Introduction
RepliedFlow (“we,” “us,” or “our”) is a brand of MRCK Technologies, operated by Mount Rock Consulting CC, a close corporation registered in the Republic of South Africa. These Terms of Service (“Terms”) govern your use of the website at repliedflow.com (the “Site”) and any services we provide (the “Services”). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.
2. Our Services
RepliedFlow provides done-for-you B2B outbound and lead generation services, including LinkedIn outreach campaigns, messaging and copywriting, profile optimisation, reply handling and follow-ups, appointment setting, and related marketing services such as branded video content creation. The specific scope, deliverables, and fees for any engagement are set out in a separate service agreement or written proposal between you and us. Where those documents conflict with these Terms, the service agreement prevails.
3. Working with LinkedIn — Important Disclaimer
Safe outreach. We conduct all outreach within what we understand to be safe, professional outreach practices on LinkedIn, including conservative activity volumes, personalised human-quality messaging, and adherence to LinkedIn’s Professional Community Policies as published from time to time.
No control over LinkedIn. LinkedIn is an independent third-party platform owned and operated by LinkedIn Corporation. We have no control over, and make no representations regarding, LinkedIn’s algorithms, terms of service, policies, enforcement practices, or any decisions LinkedIn may take — including but not limited to warnings, feature limitations, temporary restrictions, or the suspension or permanent closure of any LinkedIn account or page. Such decisions are made solely by LinkedIn and may occur without warning or explanation, even where outreach is conducted conservatively.
Assumption of risk. You acknowledge and accept that using any form of outbound activity on LinkedIn carries an inherent risk of account restriction, and that this risk exists independently of the quality or care of our work. You are responsible for maintaining your own compliance with LinkedIn’s User Agreement.
Indemnity. To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Mount Rock Consulting CC, its brands (including RepliedFlow and MRCK Technologies), and its members, employees, and contractors from and against any and all claims, demands, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with any action, decision, restriction, suspension, or termination taken by LinkedIn (or any other third-party platform) in relation to your account, profile, company page, or campaigns. We shall not be liable for any loss of business, revenue, data, connections, or opportunity resulting from any such decision by LinkedIn.

4. Client Responsibilities
You agree to: (a) provide accurate and complete information about your business, offer, and target market; (b) grant us the access reasonably required to deliver the Services (for example, access to the LinkedIn profile used for campaigns); (c) respond to booked appointments and warm leads in a timely and professional manner; and (d) ensure that your own products, services, and claims comply with applicable law. You warrant that you have the authority to authorise outreach from any account you provide to us.
5. No Guarantee of Results
Outbound marketing outcomes depend on many factors outside our control, including your market, offer, pricing, reputation, and the behaviour of third-party platforms. While we work to deliver qualified sales conversations, we do not guarantee any specific number of leads, appointments, conversions, or revenue unless expressly stated in a written service agreement.
6. Fees and Payment
Fees are set out in your service agreement or proposal. Unless otherwise agreed in writing, fees are payable in advance, monthly, and are non-refundable once a service period has commenced. We may suspend Services for accounts with overdue balances.
7. Intellectual Property
All content on this Site — including text, design, graphics, and video — is owned by or licensed to Mount Rock Consulting CC and may not be reproduced without permission. Campaign materials we create for you (such as messaging copy and video content) are licensed to you for use in your business upon payment in full for the relevant Services.
8. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Site or Services shall not exceed the fees you paid to us in the three (3) months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, business, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under the Consumer Protection Act 68 of 2008 (South Africa) where it applies.
9. Termination
Either party may terminate an engagement in accordance with the notice terms of the applicable service agreement. We may suspend or terminate access to the Site or Services immediately if you breach these Terms. Sections 3, 7, 8, and 10 survive termination.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the non-exclusive jurisdiction of the South African courts.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
